Client Success

We remain grateful and proud to be a small part of our clients’ success. Here are a few of our more recent favorite projects:


Transactions:


We assisted with the acquisition and closing of 54 acres of vacant land in Lake County, IL which our client intends to develop as a truck parking facility to transport plastic bags and dry goods for nationwide distribution. The site was a former landfill that had been closed since 1998. Our client re-graded the landfill, expanded detention areas, and successfully received the required approval from the Illinois Environmental Protection Agency (IEPA) to ensure stability for the extra load involved with truck parking. Overall, the project’s aim is to repurpose the property for commercial use while adhering to environmental and safety regulations.


In a separate project and in conjunction with attorney Michael Goldhirsh, we spearheaded the restructuring of an Illinois care facility’s $20M+ secured and unsecured debt load. We also handled the sale and acquisition of various commercial/industrial properties including manufacturing facilities, retail, and mixed-use properties as well as vacant land for both residential and commercial development purposes. We also facilitated the sale and acquisition of numerous single family and multi-unit residential properties.


Zoning:


We helped our client successfully obtain a zoning change to accommodate its growing Senior Independent Living Program. It is among the top tier nonprofit senior living providers and has over 60 years of continuous service to residents in suburban Chicago. 

 

Our firm worked to obtain zoning approval and plat of re-subdivision to existing Planned Development for our client’s restaurant. The restaurant brings a 16-unit concept operating in eight states, with 24+ years of operational excellence to the community.

 

RDA Approvals:


Shapiro & Associates Law assisted a clothing branding and manufacturing company to negotiate a development agreement for a new 50,000 sq. ft. manufacturing facility for its corporate headquarters.


Dispensary Licensing:

 

We were able to obtain a dispensary license for our client after the IDFPR wrongfully denied the license.


We also filed multiple applications for licenses for dispensaries with the IDFPR and are involved in multiple litigation cases challenging the denial of dispensary and craft grower licenses that were wrongfully denied by both the IDFPR and the Dept of Agriculture. Most of these cases are still pending.


Finally, We were fortunate to assist one of our clients obtain zoning approval for their adult use recreational cannabis dispensary in Illinois, licensed by the Department of Financial and Professional Regulation.

The Illinois Department of Financial and Professional Regulation (IDFPR) recently announced the next steps to issue 185 Conditional Adult Use Cannabis Dispensing Organization Licenses to applicants selected in three lotteries in 2021. The Conditional Licenses will be issued to applicants selected in the 2021 lotteries in three waves: Wave 1, on or before July 22, 2022. Naperville-Chicago-Elgin BLS Region. Wave 2, on or before August 5, 2022. Other BLS Regions with multiple licenses available. Wave 3, on or before August 19, 2022. BLS Regions with a single license available. Next Steps Principal officers must submit a Principal Officer Affirmation form no later than July 1, 2022. The IDFPR will then verify all principal officers are not delinquent in taxes or owe money to the State of Illinois and notify any applicant if a principal officer is not tax compliant. The applicant will then have 60 days after notification to prove tax compliance. Any applicant with a principal officer who is not tax compliant after the 60-day period shall forfeit their awarded license, which will then be offered to the next eligible applicant. The IDFPR will also verify that no principal officers have a financial interest in more than 10 Adult Use Cannabis Dispensary licenses. Any applicant with a principal officer who may become a principal officer in any combination of more than 10 Early Approval Adult Use Dispensing Organization Licenses, Conditional Adult Use Dispensing Organization Licenses, and Adult Use Dispensing Organization Licenses will forfeit any license they are awarded. After IDFPR issues the Conditional Licenses, it will conduct background checks of principal officers. Importantly, after receiving a Conditional License, the Conditional Licensees will have 180 days to select a physical storefront location and obtain the full Adult Use Dispensing Organization License (the full list of criteria to be met may be found here ). If a Conditional Licensee is unable to find a suitable physical location within the 180-day period, they may request an extension of 180 days.
